NoTrack Messenger ("NoTrack", "the app") is run by Kung Fu Giraffe, LLC, a Pennsylvania limited liability company ("we", "us"). Contact: support@no-tracking.app.
By creating an account or using NoTrack, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use NoTrack.
1. Who can use NoTrack
- You must be at least 13 years old. If you are under 13, you may not use NoTrack. We ask for your birth month and year when you sign up to check this; we don't save it.
- If you are under 18, you should review these Terms with a parent or guardian.
- NoTrack is offered in the United States.
- If we learn that someone under 13 has an account, we will delete it.
2. Your account
- You sign in with your email address and a one-time code. Keep your email account and your phone secure — anyone with access to them can access your NoTrack account.
- One account per person. Don't create accounts for other people or pretend to be someone else.
- Choose a username that follows the rules in section 4. We may change or reclaim a username that impersonates someone, is offensive, or misleads people.
- You're responsible for what happens in your account.
3. Privacy and encryption
Your messages, photos, group names and group categories are end-to-end encrypted: they are locked on your phone and can only be unlocked on your recipients' phones. We can't read them. Our Privacy Policy explains what we do store, for how long, and why.
Because we can't read messages, we rely on users to report abuse (section 5). A report includes only what the person reporting chooses to send.
4. Rules — zero tolerance
We have zero tolerance for objectionable content and abusive users. Do not use NoTrack to:
- Harass, bully, threaten, intimidate or stalk anyone.
- Share content that promotes violence, terrorism or hatred against people based on race, ethnicity, national origin, religion, disability, sex, sexual orientation, gender identity or similar characteristics.
- Share any sexual content involving anyone under 18, or contact a minor for sexual purposes. We report such content to the National Center for Missing & Exploited Children and law enforcement as required by law.
- Send sexual or graphic content to people who haven't agreed to receive it, or to anyone under 18.
- Send spam, bulk or unwanted messages, chain messages, or unsolicited advertising.
- Scam, defraud or phish people, or ask for their passwords, codes or money under false pretenses.
- Share someone's private information (such as their address, phone number or ID documents) without their permission.
- Impersonate a person, business or organization.
- Buy, sell or trade illegal goods or services, or do anything else that is illegal.
- Share content that infringes someone else's copyright, trademark or other rights.
- Send malware or harmful links, or try to break, overload, reverse-engineer or get around NoTrack's security, rate limits or other protections.
- Create accounts or send messages automatically (bots, scripts) or in bulk, or buy, sell or transfer accounts or usernames.
These rules apply everywhere in NoTrack, including group chats and invite links.
5. Reporting and blocking
- You can block anyone and report any person or group from within the app.
- Reports go to our team and are reviewed within 24 hours.
- When someone breaks these Terms, we may warn them, remove them from the service, suspend or delete their account, and stop them from creating new accounts. We decide this at our discretion, and we may act without warning.
- We cooperate with law enforcement when required by law. Because messages are end-to-end encrypted, we cannot provide message contents.
6. Groups and invite links
- Groups can have up to 500 members. Group admins can add their contacts, remove members, set the group's category and create invite links.
- Anyone who has a group's invite link or QR code can join that group until an admin resets or turns off the link. Share links carefully.
- Group admins are expected to keep their groups within these Terms. We may act on reported groups as described in section 5.
7. Your content
- You own what you send. You give us a limited permission to store and transmit it — in encrypted form — only as needed to deliver it to your recipients.
- We don't use your content for advertising, and we can't read it.
- Messages and photos are stored on our servers only until they are delivered (at most 90 days for messages and 30 days for photos if never delivered). Copies on phones are kept according to each person's Keep messages setting.
- You are responsible for keeping copies of anything important. We don't back up your chats. If you turn on iCloud Backup for chats in the app, Apple's terms apply to that backup.
8. The service
- NoTrack is currently free. We may introduce optional paid features in the future; we'll tell you before you're charged anything.
- We may change, add or remove features, or stop offering NoTrack, at any time. We'll try to give notice of major changes.
- NoTrack is not a replacement for emergency services. It can't call 911. In an emergency, use your phone's emergency calling.
9. Ending your account
- You can delete your account at any time in Settings → Delete account. This deletes your account and the data we hold about it, as described in the Privacy Policy.
- We may suspend or delete your account if you break these Terms, if required by law, or to protect other users or NoTrack.
- Sections 7 (as it relates to content already delivered), 10, 11, 12 and 14 continue to apply after your account ends.
10. Disclaimers
NoTrack is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don't promise that NoTrack will always be available, error-free, secure, or that messages will always be delivered.
11. Limitation of liability
To the fullest extent permitted by law, Kung Fu Giraffe, LLC and its members, employees and contractors are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, messages, profits or goodwill, arising from your use of NoTrack. Our total liability for any claim related to NoTrack is limited to US $50. Some places don't allow these limits, so they may not apply to you.
12. Indemnity
If you break these Terms or the law while using NoTrack and someone makes a claim against us because of it, you agree to cover our reasonable costs of that claim, including legal fees, to the extent permitted by law.
13. Apple
If you got NoTrack from Apple's App Store:
- These Terms are between you and Kung Fu Giraffe, LLC, not Apple. Apple is not responsible for NoTrack or its content.
- Apple has no obligation to provide maintenance or support for NoTrack.
- If NoTrack fails to meet any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any). Apple has no other warranty obligation for NoTrack.
- Apple is not responsible for any claims relating to NoTrack, including product liability claims, claims that it doesn't meet legal requirements, consumer protection or privacy claims, or intellectual property claims. We are responsible for those, as described in these Terms.
- You confirm that you are not located in a country subject to a U.S. government embargo or designated as "terrorist supporting", and that you are not on any U.S. government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
- Your use of NoTrack must also follow the App Store's Usage Rules.
14. Governing law and disputes
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Pennsylvania, unless the law requires otherwise.
15. Changes to these Terms
We may update these Terms. If a change is significant, we'll tell you in the app before it takes effect. If you keep using NoTrack after a change takes effect, you accept the updated Terms.
